Article 1 - Purpose

The purpose of these General Terms and Conditions (GTC) is to define the conditions under which TOYA (hereinafter referred to as ‘TOYA’) provides, via its mobile application (hereinafter referred to as the ‘Application’), services to put passengers (hereinafter referred to as ‘Customers’) in contact with independent drivers (hereinafter referred to as ‘Partner Drivers’) for the provision of urban transport services in Cameroon.

Article 2 - Acceptance of the General Terms and Conditions

By registering and using the TOYA Application, the Customer and the Chauffeur Partner expressly and unreservedly accept these Terms and Conditions. TOYA reserves the right to modify these Terms and Conditions at any time. New terms and conditions will apply as soon as they are published on the Application or website.

Article 3 - Services offered

TOYA offers a matchmaking service between :

  1. Customers wishing to order a journey in a private vehicle.

  2. Partner Drivers registered on the platform, who have suitable vehicles.

 

TOYA is not a transport company and only acts as an intermediary between the two parties.

Article 4 - Registration and use

  • For Customers: Registration for the Application is free of charge. Customers must provide accurate and up-to-date personal information.

  • For Chauffeur Partners: Chauffeur Partners must submit their required documents (ID card, driving licence, roadworthiness test and insurance) for validation before starting to use the platform.

 

TOYA reserves the right to suspend or terminate an account in the event of a breach of these Terms and Conditions or misuse of the Application.

Article 5 - Rates and payment

  • Fares: Fares for journeys are calculated automatically according to distance and the level of service chosen (Economy, Comfort, or Prestige). The estimated price is displayed to the Customer before the booking is confirmed.

  • Payment: Payment is made exclusively in cash directly to the Driver at the end of the journey.

  • Cancellation: If the Customer cancels a booking after a Driver has been assigned, cancellation charges may apply.

Article 6 - Customer obligations

The Customer undertakes to :

  • Be present at the pick-up address at the agreed time.

  • Respect the Driver and keep the vehicle clean.

  • Pay the exact fare directly to the Driver in cash.

 

In the event of inappropriate behaviour, TOYA reserves the right to suspend the customer's account.

Article 7 - Obligations of the Chauffeur Partner

The Driver-Partner undertakes to:

  • Keep his vehicle clean, in good working order and in compliance with legal requirements.

  • Respect the rules of safe driving and offer a quality service to the Customer.

  • Carry out accepted journeys without unjustified cancellation.

 

Any breach of these rules may result in the suspension or termination of the Driver's account.

Article 8 - Responsibility of TOYA

TOYA acts solely as an intermediary between Customers and Driver Partners. Therefore :

  • TOYA is not responsible for any delays, cancellations or incidents occurring during the journey.

  • Driver Partners remain solely responsible for the safety and quality of the journey.

Article 9 - Personal data

The information collected via the Application is processed in compliance with data protection regulations. This data is used exclusively to manage bookings and will not be shared with third parties without prior consent.

Article 11 - Applicable law and disputes

These GCS are governed by Cameroonian law. Any dispute shall be submitted to the competent courts of Cameroon, after an attempt at amicable resolution between the parties.

Article 10 - Complaints

In the event of a problem or dissatisfaction, the Customer or Chauffeur Partner may contact customer service via the Application or the website. TOYA undertakes to respond as quickly as possible.
